There are three Acts of law under which you can register a Non Government Organization (NGO), viz.
- Trusts Act
- Societies Act of 1860
- Section 8 of the Indian Companies Act, 1956

All the options have their advantages and disadvantages. The advantage of registering under Trusts Act is that you can keep control of the NGO. In the registration of NGO under Societies Act some other office bearers can take control of the NGO at some point of time in future. We did not find any concrete information on the internet about how to register an NGO in Delhi under the Trusts Act. We heard that we need about seven people and we need to go to Charity Commissioner etc, which are incorrect for Delhi. So we share herewith our information and experience of registering an NGO in South West Delhi. The procedure for registering in other parts of Delhi are similar. To register you have to visit the local Deputy Commissioner's (DC) office of your area. You can get information about all DC office in Delhi at Delhi Government Revenue Department website.

This will take up at least half of your day if you do all your homework in advance like getting E-Stamp papers, prepare Trust papers, get Bank draft made in advance.

  • Make a draft of Rs. 1100/- in the name of "DDO DC South West"
  • E-Stamp paper of a value equal to Three percent (3%) of amount of Trust Value or Property. E.g. for a trust of Rs. 10,000/- the amount would be  Rs. 300/-. For E-Stamp paper amounts up to Rs. 500/- you can use normal Non-Judicial stamp paper available at shops. For larger amounts need E-Stamp paper from Corporation Bank only. There is no Corporation bank near the South West DC office. The nearest are in Mahipalpur or Janakpuri (please recheck). It is suggested you buy this a day in advance.
    • The E-Stamp paper can typically be issued in two names as the space to fill names is limited so if your trust has more than one trustee you can use names of Settlor, first Trustee and the word "Others". E.g. "Ram Sharma, Suresh Chauhan & Others."
    • E-Stamp paper has space for sticking photos of trustees etc in bottom half.
    • There is only one shop across the road from South west DC office which gives E-Stamp papers up Rs. 500/- near DC office. They overcharge the commission (around Rs. 20/- per Rs. 100/-) so it is suggested you buy this before hand from some source in your area.
    • E-Stamp papers are issued by Stock Holding Corporation of India and all shops selling them are their agents.
    • Decide the names and details of E-Stamp paper before hand as NO changes can be made to it. Although you should recheck the format - typically its same as original.
  • Two people as witnesses who are above 18 years of age and must carry their ID cards. Physical presence of witnesses is required. If you don't have witnesses you can get few witnesses who are typical touts. They charge at least Rs. 150/200 to be witnesses although they might demand more.
  • Two passport size photos of Settlor and Trustees each.
  • ID proof of Settlor.

Documents required and Forms to fill:

  • Fill a Data Entry form available at Xerox shops near DC office. It costs around Rs.2/3.

  • Put two sets of fingerprints of Settlor left thumb.
  • Behind the main page put left thumb and all fingers of Settlor and Trustees with signature.
  • Put left thumb impression on all photos.
